Notice of deterioration
When an owner does not do the work required to bring a building back into good condition, the City can register a notice of deterioration (avis de détérioration) in the Quebec land register. The notice describes the work to be done and stays registered until the City registers a notice of regularization.
Because it is in the land register, the notice follows the building: a buyer takes over the situation and the work to be done. The law also lets the City go further if the work is still not done, up to acquiring the building.
On our pages a notice of deterioration is a Serious finding. Ask the seller for the list of required work, what was done and a confirmation from the City; your notary will also see it in the title examination.
